• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

10. Termination

10.1 Termination by You

You may stop using our Services at any time. If you have registered for an account, you may request deletion of your account by contacting us.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

10.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Croatia, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

If you are a consumer based in the European Union, you may also have mandatory consumer protection rights under your local laws.

12. Dispute Resolution

12.1 Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating any formal proceedings.

12.2 Binding Arbitration

If the parties are unable to resolve a dispute through informal negotiations, the dispute shall be finally resolved by binding arbitration in accordance with the Croatian Arbitration Rules. The arbitration shall be conducted in Croatia in the English or Croatian language.

12.3 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

12.4 EU Consumers

If you are a consumer based in the European Union, you may access the European Commission's online dispute resolution platform at: https://ec.europa.eu/consumers/odr

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Horizon Marketing Group concerning the Services.

13.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

No waiver by Horizon Marketing Group of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

13.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation.

13.6 Relationship of the Parties

Nothing in these Terms shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and Horizon Marketing Group.
